Binding Arbitration Clause

Agreement to Arbitrate Disputes
By using this website, purchasing products, or engaging in any services offered by The Dab Hut L.L.C. (“Company,” “we,” “us”), you agree that any dispute, controversy, or claim arising out of or relating to this Agreement, your use of the website, or any products or services sold or distributed by the Company (each a “Dispute”) will be resolved exclusively through binding arbitration as described in this clause, rather than through litigation in court.

Mandatory Arbitration Process
You and the Company agree to resolve any Dispute by binding arbitration administered by a selected third-party organization under its rules. The arbitration shall be conducted in Cassopolis, MI, and will be held before a neutral arbitrator agreed upon by both parties. If the parties are unable to agree on an arbitrator, the arbitration organization will appoint one in accordance with its rules.

Scope of Arbitration
The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this Agreement, including any claim that all or any part of this Agreement is void or voidable. The arbitrator may award any remedies that would be available in a court of law, and the decision of the arbitrator will be final and binding.

Class Action Waiver
All arbitrations shall be conducted on an individual basis. You agree that you may bring claims against the Company only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator shall not have the authority to conduct any class or collective arbitration, nor join multiple parties in a single proceeding.

Exceptions to Arbitration

Costs and Fees

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable.
